1. PREAMBLE AND ACCEPTANCE
1.1. Contractual Relationship
These Terms and Conditions (“Terms,” “Agreement”) constitute a legally binding agreement between Dream MBBS Private Limited (hereinafter referred to as “Company,” “We,” “Us,” or “Our”), a company incorporated under the Companies Act, 2013, having its Registered Office at Janta Bazar, Dandaspur, Saran, Bihar, India-841224 and Corporate Office at 115, 1st Floor, Ithum Tower-A, Noida Sector-62, Uttar Pradesh, India-201301, and the user/visitor (hereinafter referred to as “User,” “You,” “Student,” or “Parent/Guardian”) accessing our website www.dreammbbs.in (“Website”) or availing our counseling and admission services.
1.2. Transition of Legacy
The User acknowledges that Dream MBBS Study Abroad LLP has evolved and restructured into Dream MBBS Pvt Ltd. All legacy goodwill, ongoing services, and digital assets have been legally transferred. By continuing to use this Website or our services, you acknowledge dealing with Dream MBBS Pvt Ltd as the sole legal entity.
1.3. Acceptance
By accessing, browsing, or using this Website, or by signing up for our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately cease using our services and exit the Website.
2. SCOPE OF SERVICES
2.1. Advisory Role Only
Dream MBBS Pvt Ltd acts solely as an Educational Consultant and Facilitator. We bridge the gap between aspiring medical students and foreign universities.
- We DO: Provide counseling, assist in university selection, guide documentation, assist with translation/apostille, and facilitate the admission application process.
- We DO NOT: Guarantee the issuance of a Visa, guarantee the completion of the degree, guarantee clearance of the FMGE/NExT exam, or control the internal policies of foreign universities or governments.
2.2. No Agency Relationship
The Company is an independent facilitator and not an agent, partner, or joint venture of any foreign university unless explicitly stated otherwise in specific agreements. We do not have the authority to bind foreign universities to any agreement.
3. ELIGIBILITY AND USER CONDUCT
3.1. Eligibility
You must be at least 18 years of age to enter into this Agreement. If you are a student under 18, this Agreement must be accepted by your legal guardian or parent who agrees to be bound by these Terms.
3.2. Accuracy of Information
You agree to provide true, accurate, current, and complete information about yourself/the student as prompted by our registration forms. Providing false, forged, or misleading documents (mark sheets, NEET scores, passports) will result in immediate termination of services without refund and potential legal action.
3.3. Prohibited Conduct
Users are strictly prohibited from:
- Using the Website for any unlawful purpose.
- Attempting to breach the security, servers, or network of the Company.
- Harassing, intimidating, or using abusive language towards our counselors or staff.
- Posting libelous, defamatory, or obscene content about the Company on social media or public forums.
4. ADMISSION, VISA, AND TRAVEL
4.1. University Admission
Admission to any foreign medical university is subject to the exclusive discretion of the University. The Company is not liable if a University rejects an application due to capacity, academic criteria, or policy changes.
4.2. Visa Issuance
The Granting or Rejection of a Student Visa is the sole prerogative of the respective Embassy or Consulate. Dream MBBS Pvt Ltd assists in the documentation, but cannot guarantee the issuance of a Visa. The Company is not liable for any losses arising from Visa rejection or delay.
4.3. Travel & Logistics
While we assist with travel arrangements through our partners, the Company is not liable for flight cancellations, delays, baggage loss, or immigration issues at the border.
5. ACADEMIC AND REGULATORY DISCLAIMER
5.1. NMC/NExT Regulations
The Company guides students based on the current guidelines of the National Medical Commission (NMC) of India. However, regulations regarding FMGE, NExT, or foreign medical graduate licensing are subject to change by the Government of India. Dream MBBS Pvt Ltd shall not be held liable for any future changes in government policies that may affect the validity of a degree or eligibility to practice in India.
5.2. Foreign Laws
Students are subject to the laws of the host country (e.g., Russia, Uzbekistan). The Company is not responsible for legal actions taken against a student for violating the laws, university rules, or code of conduct in the foreign country.
6. PAYMENTS, FEES, AND TAXES
6.1. Consultancy Fees
All consultancy fees paid to Dream MBBS Pvt Ltd are for the service of counseling and documentation guidance. These fees are non-refundable once the process has been initiated, as per our Refund Policy.
6.2. University Fees
Tuition and Hostel fees are usually paid directly to the University. If the Company facilitates this transfer, we act only as a remitter. We are not liable for fee hikes implemented by the University.
6.3. Currency Fluctuation
All fees quoted in USD, Rubles, or other foreign currencies are subject to market fluctuation. The User bears the cost of currency exchange rates at the time of payment.
6.4. Taxes
All payments made to the Company are subject to applicable taxes (GST) as per the Government of India norms.
7. INTELLECTUAL PROPERTY RIGHTS
7.1. Ownership
All content on this Website, including but not limited to text, graphics, logos (including the Dream MBBS logo), button icons, images, audio clips, digital downloads, and software, is the property of Dream MBBS Pvt Ltd and is protected by Indian and international copyright laws.
7.2. Limited License
You are granted a limited license to access and make personal use of this Website. You may not download (other than page caching), modify, copy, reproduce, or resell any portion of it without express written consent from the Company.
8. LIMITATION OF LIABILITY
8.1. Maximum Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF DREAM MBBS PVT LTD, ITS DIRECTORS, EMPLOYEES, AND AGENTS, FOR ANY CLAIM ARISING OUT OF THIS AGREEMENT (WHETHER IN CONTRACT, TORT, OR OTHERWISE) SHALL NOT EXCEED THE CONSULTANCY FEE ACTUALLY PAID BY THE USER TO THE COMPANY.
8.2. No Consequential Damages
In no event shall the Company be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of academic year, loss of career opportunity, mental distress, or travel expenses, arising from the use of our services.
8.3. Third-Party Services
We are not liable for the acts, errors, omissions, representations, warranties, breaches, or negligence of any third-party service providers (Airlines, Forex agents, Insurers) or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom.
9. INDEMNIFICATION
The User agrees to indemnify, defend, and hold harmless Dream MBBS Pvt Ltd and its affiliates, officers, directors, and employees from any and all claims, liabilities, damages, and costs (including legal fees) arising from:
- Your use of the Website or Services.
- Your violation of these Terms.
- Your violation of any third-party right or University regulation.
- Any false or forged information provided by you.
10. FORCE MAJEURE
The Company shall not be liable for any failure to perform its obligations where such failure is a result of Acts of Nature (including fire, flood, earthquake, storm, hurricane, or other natural disasters), war, invasion, act of foreign enemies, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, military or usurped power, confiscation, terrorist activities, nationalization, government sanction, blockage, embargo, labor dispute, strike, lockout, or interruption or failure of electricity or telephone service (including the collapse of the internet).
Specific Note: In the event of a war or pandemic in the destination country, the Company will assist to the best of its ability but is not financially liable for evacuations or discontinued education.
11. DISPUTE RESOLUTION AND JURISDICTION
11.1. Amicable Settlement
In the event of any dispute or difference arising between the parties, they shall attempt to resolve the same amicably through mutual negotiation within 30 days.
11.2. Arbitration
If the dispute is not resolved amicably, it shall be referred to a sole arbitrator appointed by the Directors of Dream MBBS Pvt Ltd. The arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Noida, Uttar Pradesh.
11.3. Governing Law & Jurisdiction
This Agreement shall be governed by the laws of India. The User explicitly agrees that the courts in Noida shall have exclusive jurisdiction over any disputes arising out of or relating to this Agreement, to the exclusion of all other courts.
